The Right to Manage (RTM) is a legal right that allows leaseholders to take over the management of their building from the freeholder without proving mismanagement or paying compensation.

Why Leaseholders Choose RTM

Many leaseholders suffer poor service from their freeholder's chosen managing agent — high service charges, slow maintenance response, lack of transparency, and little accountability. RTM changes that.

Under the Commonhold and Leasehold Reform Act 2002, qualifying leaseholders have a no-fault right to take over management. You do not need to prove the freeholder has done anything wrong — you simply exercise your statutory right.

Step-by-Step RTM Claim

01

Check Your Eligibility

At least 50% of leaseholders in the building must want to participate. Most residential flats qualify, but there are exceptions (e.g. buildings with more than 25% commercial use).

02

Form an RTM Company

Leaseholders form a limited company specifically set up to acquire the management of the building. This is a straightforward Companies House registration.

03

Invite Participation

A formal Invitation to Participate notice is served on all qualifying leaseholders who have not yet joined the RTM company, giving them 14 days to respond.

04

Serve a Claim Notice

The RTM company serves a formal Claim Notice on the current freeholder/managing agent. They have one month to respond with a counter-notice if they wish to dispute.

05

Dispute Resolution (if needed)

If the freeholder disputes the claim, the matter goes to the First-tier Tribunal (Property Chamber). In practice, most claims proceed unchallenged.

06

Take Over Management

Three months after the Claim Notice (or after any dispute is resolved), management transfers to the RTM company. You are now in control.
